Ukraine: pro-rated tariff rate quotas resume as EU Autonomous Trade Measure not renewed

The European Commission on 5 June published the Commission Implementing Regulation (EU) 2025/1132 of 3 June 2025 amending Implementing Regulations (EU) 2020/761 and (EU) 2020/1988 as regards tariff rate quotas for products originating in Ukraine in 2025 in the Official Journal of the European Union.

This Regulation entered into force on the day following that of its publication in the Official Journal of the European Union, and applied from 6 June 2025.

It will be recalled that the “Autonomous Trade Measure Regulation”, Regulation (EU) 2024/1392 of the European Parliament and of the Council, laid down temporary trade liberalisation measures that supplement trade concessions for Ukrainian products. That Regulation suspended all tariff-rate quotas established under Annex I-A to the Association Agreement between the European Union and the European Atomic Energy Community and their Member States, of the one part, and Ukraine, of the other part (the ‘Association Agreement’) until 5 June 2025. After this date, trade between the Union and Ukraine is to revert to the rules established under the Association Agreement.

This regulation puts into place the quantities for the quotas under the Association Agreement, which are pro-rated on a proportional basis for the remainder of the calendar year, until 31 December 2025.

Ukraine has 40 tariff rate quotas under its Association Agreement with the EU. Of the products that Ukraine has under the DCFTA, those of concern to FRUCOM members may be
